condition however. That the said Charles R. Jones and Robert E. Cochran[e] shall recover or undertake to recover the said property by foreclosure of said mortgage, or by other necessary legal proceedings from all adverse claimants, paying all legal expenses and disbursements and holding the said T.C. Durant and W.W. Durant, their heirs, representatives and assigns harmless from the payments of the same, with the proviso, however that in case of recovery the said Jones and Cochrane shall be allowed their legal expenses and disbursements up to the sum of five hundred dollars should they amount to so much, which shall be deducted from the amount of the recovery, before a division shall be made, and after such deduction, the said land property or moneys so received shall be divided into two equal parts, the said Jones and Cochrane receiving one half for their services, and the remaining half to be paid over to T.C.
