This indenture made this the first day of March in the year of our Lord one thousand eight hundred & fifty four, between Caleb Phifer & George L. Phifer, both of the county of [illegible] & state of North Carolina, of the one part, and Thomas C. Durant, Trustee for himself & his associates, of the county & state of New York, or the other part witnesseth: that the said party of the first part, for and in consideration of the sum of twelve thousand dollars, to them in hand paid, the receipt of which is hereby acknowledged, hath bargained & sold, aliened & confirmed, and doth hereby bargain & sell, alien & confirm unto the said party of the second part, his heirs & assigns forever, in trust for himself & his associates, all the mines, minerals & mineral interests, in, to & upon, the following tracts, pieces & parcels of land, situate, lying & being in the county of Union & state of North Carolina, in or near the waters of Duck Creek; one tract adjoining the lands of [Sutten?] Williams & others, & [branded?] as [fellows?], to a unit, Beginning at a port oak, on the Bank of said creek, formerly [illegible] & now Sutten Williams Corner, & runs south 3 west 47 poles, to a small port oak, formerly Kern's Corner, thence North 68 west 66 poles, to a dead Pine, on the side of a Road, thence South, 2 west 86 poles, to a Port oak, thence South, 62 west 148 poles to a white oak, on the side of a Road, thence North 16 1/2 west 114 poles to a Bunch of Poplars, on the Bank of the creek, thence south 60 East 30 poles, to a stake in the field, thence North 23 West 38 poles, to a Mulberry on the Bank of the creek, thence the various courses of the creek, allowing the channel of the creek to be the line, [abut?] with 33 West 32 poles to a large Poplar, on the creek, formerly [illegible] corner,
