of the proceeds thereof among its fair and honest Creditors as prescribed by law. And whereas on reading and filing the Report of said Philo T. Ruggles Referee, and the Bond of the Receiver approved by this Court at a Special term of the said Supreme Court held as aforesaid on the seventeenth day of October eighteen hundred and fifty five present the Honorable William Mitchell Justice. It was further ordered that the said Report be confirmed and that the said James W. Gerard Junior be and he was thereby appointed Receiver of the property and effects of the said the Lindsay Mining Company and of their debts equitable interests and things in action and to take charge of the same and to collect sue for and recover all debts and demands and with the power and authority as directed in the first above mentioned decree of the Court. And whereas pursuant to the above recited Decree and order and to the provisions of the Revised Statutes of the State of New York and after due publication of a notice of sale as required by law, the said party of the first part Receiver as aforesaid by W. H. Franklin & Son Auctioneers did expose for sale at public auction to the highest bidder at the Merchants Exchange in the City of New York on the day of the date hereof the hereinafter described property and
