difference or discrepcy "evidence" that they have located a part of estimate for the Cut somewhere else nearly 1000$ Dollars which they have given us Credit for that does not appear in that place (within the Stations of the Cut) to their Credit and if that is somewhere else in the account is it not probible and plusible that the Ballance of that 2nd estimate is along with it and is it not more than likely that that stone work thrown into the fill belongs to our cut at all events we can (swear truthfully) and prove by all the men that worked there - that there was not Rock work done between those stations from Station 39 to 49 + 66 except by M M. Cahoon and Co. and consequently we legaly lawfuly and honestly claim the pay for all the Rock work estimated and located between those stations This is our position, and what we claim - they of course do not intend to allow us the Cr. or they would not have thrown it in between those stations to keep it out of our hands - they have taken other advantages of us by trumping up heavy charges against the works to the amt. of several thousand dollars but we shall have to make the best we can of that, we have no means to spend in lawing - but we see no other way then to stop sufficient pay in your hands to secure us - unless you would use your influence in our behalf to obtain a satisfactory settlement - trusting in your experience and ability we submit this statement for your consideration and council and shall be forever grateful for any interest you may take in our welfare Yours most Respectfully M M and D.S.
