Deposition of Witnesses to be used in Evidence in certain action now pending in the Court of Common Pleas for the County of Cuyahoga and State of Ohio wherein the Corn Exchange Bank is Plaintiff and Henry W Clarke & others are Defendants April 21st 1858. Thomas C Durant of the City of Brooklyn in the County of Kings in the State of New York, of lawful age, being first duly sworn deposes & says as follows. Q Where do you reside A In the City of Brooklyn Q In August & September last were you acquainted with A.G. Jerome? A I was Q What was his business? A A Broker Q What was your business at the same time? A A Merchant & Contractor Q Were you one of the Directors of the Corn Exchange Bank at that time and are you still? A Yes Q Did A.G. Jerome deliver to you a Draft drawn by Henry W Clarke of Cleaveland and if so when? A He delivered me a Draft for $5000 on Atwood & Co Q Describe the Draft? A Drawn by Henry W Clarke to the order of J Morrison, endorsed by J Morrison and E.G. Williams drawn on Atwood & Co at 4 months after Date; Dated Cleaveland May 20 1857. and acceptance waived Q Have you once been examined on the part of the Plaintiffs in this action touching this Draft? A I have Q From whom did Jerome get the Draft? A I do not know he said he got it from parties who made it
