We have been delayed in finishing the Right of Way in case of Non Residents and a few others by the want of some law authorising us to condemn property - The general Rail Road law passed last winter by the territorial legislature, is the most complete for Rail Road legislation of any that has ever been passed by any legislature, it is inoperative from the refusal of the Company to accept its provisions - if Congress will pass a law enabling us to condemn the Right of way we can finish very soon - If they do not I see no way in which we can secure the remaining cases without paying too much for them. Three months ago the right of way would have cost less if it could have been appraised than it will now - This matter wants some solution immediately and if no Congressional legislation can be obtained soon, it will be better to accept this Bill and designate the clauses of the General law you object to and when the next legislature is in session try and get it changed Respectfully Yours Peter A Dey
