Whereas under and virtue of a certain instrument dated November 1, 1868, by and between the Union Pacific Railroad Company, and James W. Davis, and by virtue of a certain assignment thereof, in writing dated November 6, 1868, made by the said James W. Davis to Oliver Ames, Thomas C. Durant, John Duff, Sidney Dillon, H. S. McComb, B. E. Bates, and C. S. Bushnell, as trustees for the stockholders of the said Union Pacific Railroad Company, Thomas C. Durant as one of said stockholders and persons beneficially interested under the said instruments, claims to be entitled to an accounting on the matters of the trusts therein referred to, and to the payment of a certain large sums of money by and from the said Union Pacific Railroad Company, the Credit Mobilier of America and the persons specified in said assignment as trustees, of whom Sidney Dillon, H. S. McComb, C. S. Bushnell, Fred. L. Ames, and F. Gordon Dexter are the survivors and successors, the said Oliver Ames, B. E. Bates and John Duff having departed this life, and the said Fred L. Ames, and F. Gordon Dexter having succeeded to the place of said Oliver and Ames and B. E. Bates in said trust.
