Whereas I Oliver Ames, of Boston, was heretofore duly appointed Receiver of the Credit Mobilier of America by an order of the Circuit Court of the United States for the Eastern District of Pennsylvania, to which order reference is made for the nature and extent of my powers and whereas, There stands in the name of Thomas C. Durant, Trustee, the title to certain lands in the state of Iowa in or near Council Bluffs in the County of Pottawottamie, and also certain lands in the County of Platte, in the State of Nebraska, and whereas, litigations are pending between the said Durant and the Credit Mobilier in respect thereof and whereas The said Durant has agreed with the Credit Mobilier to convey to it by quit claim the title to the said lands, in consideration, among other things, of receivig a release from the Receiver of the Credit Mobilier to the full extent, and only to the full extent, that the said Receiver is or may be authorized to give the same.
