said Company shall resume the full control and possession of said Road and property above named. This further understood that neither of said Agents and Attorneys shall be responsible for the acts, neglects, or defaults of the other. In Witness Whereof the said the Mississippi and Missouri Rail Road Company and the said Thomas C. Durant and Henry Day have mutually set to these presents their respective seals the Eighth day of May Eighteen Hundred and Sixty Three. Geo M. David Treasurer H. Price Secty.
