(Copy) Whereas a certain agreement in writing tripartite, dated October 15th, 1867, was made by and between Oakes Ames of the first part, Thomas C Durant, Oliver Ames, John Balley, Sidney Dillon, Cornelius S Bushnell, Henry S McComb and Benjamin E Bates of the second part, and the Credit Mobelier of America of the third part; unto which agreement reference is hereby made, and whereas the said parties of the second part in pursuance of a stipulation contained in said contract have called on party of the third part to advance moneys necessary to enable said parties of the second part economically and promptly to execute and perform the conditions of a certain contract in said agreement mentioned, and the said party of the third part being unable to make such advances, has made default thereon, Now in consideration of the premises, and of One dollar to the said party of the third part, in hand paid, the receipt whereof is hereby acknowledged, and for divers other good and valuable
