Emott being duly sworn, says: That he is one of the firm of Emott Hammond Strickney, attorneys and Counsellors for the defendant herein: That the summons in this action was served on the 2nd day of March 1872 and the complaint therein was served on the 24th day of January 1873, the time for the service thereof having been extended to that date by consent of the said defendants attorneys: That the time to answer the said complaint expired on the 13th day of February 1873: That from the vague and indefinite nature of the allegations of said complaint it will be impossible properly to prepare an answer thereto unless the allegations contained in the Second
