Supreme Court Thomas C. Durant et. al. against The Union Pacific Rail Road Company et. al. City and County of New York ss: Henry Wagner Jr. being duly sworn says that he is over nineteen years of age that on the 4th day of August 1875 he served the annexed summons on the Union Pacific Rail Road Company by delivering a copy thereof to Sidney Dillon personally, the President of said Company at No. 23 Nassau Street in the City of New York, and that deponent knew the Company so served to be the company mentioned and described in the Summons as defendant therein; and also on the same day and at the same place deponent served the said summons on said Sidney Dillon individually by delivering to and leaving with said Dillon a copy thereof, and that deponent knew the person so served as last aforesaid to be the person mentioned and described in the summons as defendant therein.
