Newport, R.I., June 24- 1875 Dr. Thomas C. Durant Dear Sir After a consultation today with Gov. Van Zandt in reference to our motion to purge from contempt in the case of Hazard et al. vs Durant et al, which is to be heard on the 9th [Prox.?] we have come to the conclusion that the only weak points are the two to cover which I have drawn up the enclosed affadavit for you to take. - The first is this. - In your agreement with Hazard (the one which was signed by both) dated Sept 28th it is stipulated as follows: "But the said Durant shall not be relieved from any of his liabilities under said injunction or for any breach thereof except on fulfilment of the agreements of which Sidney Bartlett Esq now has a memorandum." - (This is marked "Schedule A).
