I., Oct 19 - 1875 Charles Tracy Esq Dear Sir Whilst waiting for the decision of the Court upon the motion now pending in Hazard vs. Durant we have thought it proper to notify the Judges of our intention to introduce the evidence setting forth the discovery that the stock for receiving which Durant was adjudged in contempt was in fact not received in violation of the injunction and we now want as soon as possible affidavits of the following facts 1st. That the dividend of 11,316 shares of U. P. R. R. Stock should have been declared under the Davis contract and not under the Ames contract. 2nd. That the trustees of these contracts
