Providence R.I. Dec 24th 1875 My Dear Sir I have your favor. It would have been better to send the motive to Counsel for examination rather than to send it to Durant who is to retain it an indefinite time. Durant is in a very bad scrape in these cases and only vigilant attentive care save him from a decree for a large amount and his surety from a very serious risk. The Court have this day [fixed?] Saturday January 1st 1876 for the hearing of the motive and we cannot count upon getting any more time. I want the affidavits if it is possible to obtain them of the Directors in the N.P.R.R. Co. and C.M. of Am at the time of the Commencement of this suit that norequest was made upon them to commence suit against Durant
