after being carefully examined cautioned and sworn to testify the truth the whole truth and nothing but the truth, gave the foregoing deposition which was reduced to writing by me in his presence, and by him subscribed in my presence. - Taken at the request of Thomas C. Durant to be used on the trial of a suit now pending in the Supreme Court of the State of Rhode Island, before James Tillinghast Esquire one of the Masters in Chancery of said Court wherein said Thomas C. Durant is one of the defendants, and Isaac P. Hazard and others are complainants. The known attorney of the adverse party (Francis B. Peckham Esquire) was duly notified of the caption of this deposition, as will appear by the return on the back of the citation hereto answered and was (present, or represented by Esquire attorney-at-law who was present for him). - I further certify that I am not interested in nor of counsel for, nor attorney of either party in said suit. - Attest. - William Sutphen Notary Public seal
