whole $40000. - upon this subscription - And so also with the other disbursements in the account stated by Hain (p. 38) except the $13000. Hain states these as disbursements and does not intimate that they were not actually expended. Indeed from his saying that for the $429719.35 - and the $168874.45 there were no vouchers it is fairly inferable that for these other sums there were vouchers. A comparison also with Mr. Durant's accounts shows that all these items there appear; - and while these accounts of themselves would not be sufficient to discharge him I think that they may properly be referred to when thus confirmatory of the other evidence. But as to this $13000 it now appears from Mr. Durant's general account (Hardy depositions Ex. No. 10 Calhoun) that he had otherwise received this amount directly from the Credit Mobilier, though for some unexplained reason it did not get credited upon his books. It was therefore
