den of accounting for these moneys traced directly to his hands on vouchers appearing upon their face to be his own personal obligations; -- and this I do not think he has at all satisfactorily done -- The most that can be claimed respecting them upon the evidence is that they were expended at Washington in the controversies or settlement between the Rail Road Company and its Eastern division, which resulted in the amendment to the Rail Road Company's Charter of July 2d 1864. But assuming this, and assuming that they were properly so expended (which the Complainants deny), I fail to see how it is any justification for Mr. Durant's receiving them from the Credit Mobilier. I therefore charge him with them with interest from the dates given to them by Crane in charging them to the suspense account. The dividend of July 8th 1868 should as claimed by the Complainants, have been [in margin:] The C.M. assured all these payments under its [agency?]
