Deposition of Oliver W. Barnes who having been called for cross ex-amination, and having been first duly sworn, testifies as follows: Interrogatory No. 1. Did you make an affidavit in this case on the 29th of April 1874? Answer No. 1. I cannot recollect the exact date, but I remember making an affidavit in this case. Int. No. 2 Look at this copy of your affidavit in printed pamphlet, entitled, "Testimony for Complainants, No. 2" and see if it appears to be a correct copy. Ans. No 2 As near as I can recollect it appears to be a correct copy: it is so long ago, that I can not tell whther it is a precise copy or not. Int. No. 3 Do you intend to say that the amount paid in on the five per cent. you spoke of there was only $250.75? Ans. No. 3 No Sir. the true amount was $25.075. instead of $250.75. Int. No. 4 To whom did you sell the 5015 shares that you refer to? Ans. No. 4 The person who presented himself to make the purchase was George Francis Train. Int. No. 5 Was not the $5000, in cash to which
