Mr Peckham - I think, to state the object for which we want it on cross examination would tend to defeat that very object. It is not pertinent, of course it can be excluded. We are not befir [sic] a jury. He declines to answer the question. [We?] consider it entirely pertinent to this case and I suppose to show the relevancy from the answer if the answer is what I suppose it will be. If I state what I expect he will testify to I don't think it will be worth my while to ask it.
