on the [illegible] 3d of February 1864, that said Hallett executed a contract in writing with you, mutually signed and sealed and whereby said Samuel Hallett represented and stated to you certain facts and circumstances as true and in [?] which said and certain adjustments therein were made between the [five?] parties and that the contract to which I have just referred is the contract which you presented here this morning and is marked "Exhibit 3"

A. He made a contract with me about that date and the contract that I presented here this morning is the contract that I made; or a copy of it rather
489 - Q. Have you any of the Land Grant Bonds which said Rail road Co. was lawfully entitled to issue (give) bonds for, that were issued prior to that time?
A. Well I don't recollect now!
490 - Q. Did you not in the suit of Thos C Durant against the Union Pacific R.R. Co Easter Div. and others, to which I have lately [confirmed?]
