Received at Charlotte N.C June 17th 1886 R.E. Cochrane Mngr Whereas on the 6th day of July 1857, one Robert Taylor, and his wife Emily Taylor of the city of New York did execute a certain mortgage on a certain tract of land lying, being and situated in the county of Union and State of North Carolina, lying on Goose Creek and at that time adjoining the lands of Eli Stewart, Amos Stevens and others containing seven hundred and ninety three acres and known as the Lemmonds Gold Mine tract, to one Thomas C. Durant of the City of New York and Whereas on the 4th day of March 1859 Thomas C. Durant aforesaid assigned said mortgage to Charles W. Durant also of the city of New York and Whereas at the date of and signing of this instrument the said debt and mortgage has never been foreclosed, and the said land is now in the possession of adverse claimants, Now therefore we T.C. Durant, executor of the estate of Charles W. Durant and W. W. Durant administrator of the estate of Thomas C. Durant do hereby constitute and appoint Charles Jones and Robert E. Cochrane of the city of Charlotte and state of North Carolina, our lawful agents and attorneys to ascertain and recover whatever rights, titles and interests we or either of us may have in said lands, for ourselves representatives, heirs and assigns, with the right to foreclose said mortgage, with full power to bring an action for the recovery of said property in the State or Federal Courts in the maintenance of our rights and interests, to ask, demand, recover and receive, to give acquittance for, compound and settle all claims and demands we or either of us may have, or that our heirs, representatives or assigns, may have in said property by reason of said debt and mortgage and to do all other things they or their attorneys may deem right and proper to protect said property, or to recover possession of the same, upon the
