7 1 (1) any inn, hotel, motel, or other establishment 2 which provides lodging to transient guests, other than an 3 establishment located within a building which contains 4 not more than five rooms for rent or hire and which is 5 actually occupied by the proprietor of such establish- 6 ment as his residence; 7 (2) any restaurant, cafeteria, lunchroom, lunch 8 counter, soda fountain, or other facility principally en- 9 gaged in selling food for consumption on the premises, 10 including, but not limited to, any such facility located 11 on the premises of any retail establishment; or any gaso- 12 line station; 13 (3) any motion picture house, theater, concert 14 hall, sports arena, stadium or other place of exhibition 15 or entertainment; and 16 (4) any establishment (A) (i) which is physically 17 located within the premises of any establishment other- 18 wise covered by this subsection, or (ii) within the prem- 19 ises of which is physically located any such covered 20 establishment, and (B) which holds itself out as serving 21 patrons of such covered establishment. 22 (c) The operations of an establishment affect commerce 23 within the meaning of this title if (1) it is one of the estab- 24 lishments described in paragraph (1) of subsection (b); (2) 25 in the case of an establishment described in paragraph (2)
