8 1 of subsection (b), it serves or offers to serve interstate 2 travelers or a substantial portion of the food which it serves, 3 or gasoline or other products which it sells, has moved in com- 4 merce; (3) in the case of an establishment described in 5 paragraph (3) of subsection (b), it customarily presents 6 films, performances, athletic teams, exhibitions, or other 7 sources of entertainment which move in commerce; and 8 (4) in the case of an establishment described in paragraph 9 (4) of subsection (b), it is physically located within the 10 premises of, or there is physically located within its premises, 11 an establishment the operations of which affect commerce 12 within the meaning of this subsection. For purposes of this 13 section, "commerce" means travel, trade, traffic, commerce, 14 transportation, or communication among the several States, 15 of between the District of Columbia and any State, or be- 16 tween any foreign country or any territory or possession and 17 any State or the District of Columbia, or between points in 18 the same State but through any other State or the District of 19 Columbia or a foreign country. 20 (b) Discrimination or segregation by an establishment 21 is supported by State action within the meaning of this title 22 if such discrimination or segregation (1) is carried on under 23 color of any law, statute, ordinance, or regulation; or (2) 24 is carried on under color of any custom or usage required or 25 enforced by officials of the State or political subdivision
