21 1 mitted to continue in attendance at a public college by 2 reason of race, color, religion, or national origin, 3 and the Attorney General believes the compliant is mer- 4 torious and certifies that the signer or signers of such com- 5 pliant are unable, in his judgment, to initiate and maintain 6 appropriate legal proceedings for relief and that the institu- 7 tion of an action will materially further the orderly achieve- 8 ment of desegregation in public education, the Attorney Gen- 9 eral is authorized, after giving notice of such complaint to 10 the appropriate school board or college authority and after 11 certifying that he is satisfied that such board or authority 12 has had a reasonable time to adjust the conditions alleged in 13 such complaint, to institute for or in the name of the United 14 States a civil action in any appropriate district court of the 15 United States against such parties and for such relief as 16 may be appropriate, and such court shall have and shall exer- 17 cise jurisdiction of proceedings instituted pursuant to this 18 section, provided that nothing herein shall empower any 19 official or court of the United States to issue any order 20 seeking to achieve a racial balance in any school by requir- 21 ing the transportation of pupils or students from one school 22 to another or one school district to another in order to 23 achieve such racial balance, or otherwise enlarge the exist- 24 ing power of the court to insure compliance with constitu-
