44 1 gram in effect pursuant to or administered under any 2 statute of the United States or any Executive order of 3 the President; and 4 (2) such individual has not fulfilled or has ceased 5 to fulfill that requirement. 6 (h) Notwithstanding any other provision of this title, 7 it shall not be an unlawful employement practice for an em- 8 ployer to apply diferent standards of compensation, or dif- 9 ferent terms, conditions, or privileges of employment pur- 10 suant to a bona fide seniority or merit system, or a system 11 which measures earnings by quantity or quality of production 12 or to employees who work in defferent locations, provided 13 that such differences are not the result of an intention to 14 discriminate because of race, color, religion, sex, or national 15 origin. 16 (i) Nothing contained in this title shall apply to any busi- 17 ness or enterprise on or near an Indian reservation with re 18 spect to any publicly announced employment practice of such 19 business or enterprise under which a preferencial treatment 20 is given to any individual because he is an Indian living on 21 or near a reservation. 22 (j) Nothing contained in this title shall be interpreted 23 to require any employer, employment agency, labor orga- 24 nization, or joint labor-management committee subject to this 25 title to grant preferential treatment to any individual or to
