45 1 any group because of the race, color, religion, sex, or na- 2 tional origin of such individual or group on account of 3 an imbalance which may exist with respect to the 4 total number or percentage of persons of any race, color, 5 religion, sex, or national origin employed by any employer, 6 referred or classified for employment by any employment 7 agency or labor organization, admitted to membership or 8 classified by any labor organization, or admitted to, or em- 9 ployed in, any apprenticeship ot other training program, in 10 comparison with the total number or percentage of persons 11 of such race, color, religion, sex, or national origin in any 12 community, State, section, or other area, or in the available 13 work force in any community, State, section or other area. 14 OTHER UNLAWFUL EMPLOYMENT PRACTICES 15 Sec. 704. (a) It shall be an unlawful employment 16 practice for an employer to discriminate against any of his 17 employees or applicants for employment, for an employ- 18 ment agency to discriminate against any individual, or for 19 a labor organization to discriminate against any member 20 thereof or applicant for membership, because he has opposed 21 any practice made an unlawful employment practice by this 22 title, or because he has made a charge, testified, assisted, or 23 participated in any manner in an investigation, proceeding, 24 or hearing under this title. 25 (b) It shall be an unlawful employment practice for
