66 1 RULES AND REGULATIONS 2 SEC. 713. (a) The Commission shall have authority from 3 time to time to issue, amend, or rescind suitable procedural 4 regulations to carry out the provisions of this title. Regula- 5 tions issued under this section shall be in conformity with the 6 standards and limitations of the Administrative Procedure 7 Act. 8 (b) In any action or proceeding based on any alleged 9 unlawful employment practice, no person shall be subject to 10 any liability or punishment for or on account of (1) the 11 commission by such person of an unlawful employment prac- 12 tice if he pleads and proves that the act or omission com- 13 plained of was in good faith, in conformity with, and in 14 reliance on any written interpretation or opinion of the 15 Commission, or (2) the failure of such person to publish 16 and file any information required by any provision of this 17 title if he pleads and proves that he failed to publish and 18 file such information in good faith, in conformity with the 19 instructions of the Commission issued under this title regard- 20 ing the filing of such information. Such a defense, if estab- 21 lished, shall be a bar to the action or proceeding, not- 22 withstanding that (A) after such act or omission, such 23 interpretation or opinion is modified or escinded or is deter- 24 mined by judicial authority to be invalid or of no legal 25 effect, or (B) after publishing or filing the description and
