This Indenture made the eightenth day of september in the seventh yeare of the raigne of our most gratious soveraigne Lady Anne by the grais of God Queene of Greate Britaine Ffrance and Ireland Defender of the ffaith &c Annoq Dmi 1708 Betweene Richard Elkington of Newton Harcourt in the County of Leicester yeoman and Ffrances his wife of the one part And Babington Bradley of the Newarke neare the Burrough of Leicester in the said County of Leicester Doctor in phisicke and Thomas Ffletcher of Syston als Sytheston in the County of Leicester aforesaid yeoman of the other part Whereas the said Richard Elkington and Ffrances his wife together with Thomas Allen the younger and William Whattofe and Mary his wife did in the terme of the holy Trinity last past before the date of those presents acknowledge and levy in her Majesties Court of Comon Bench at Westminster unto the said Babington Bradley and Thomas Ffletcher and their heires or to the heires of one of them one ffine sur cocnizance de droit come ceo &c according to the usuall course of leving of such fines is the said court and according to the forme of the statute in that case made and provided Of [all?] that cottage or tenement with the appurts scituate standing and being in Newton Harcourt aforesaid and now or late in the tenure of the said Richard Elkington his Assignee or Assignes And alsoe of all and all manner of outhouses buildings barnes stables orchards gardens yards backsides hedges ditches mounds fences trees wayes easements passages priviledges proffitts comons advantages hereditaments and appurts whatsoever to the said cottage or tenement and premisses belonging or in any wise appertayning or accepted reputed taken or knowne as part parcell or member thereof or therewith usually used lett occupyed or enjoyed And of the revercon and revercons remainder and remainders thereof And alsoe of certaine lands and hereditaments in Syston als Sytheston in the said County of Leicester and in the Newarke aforesaid in the said ffine comprized By the name or names of three Messuages one cottage three gardens two orchards thirty acres of land five acres of meadow ten acres of pasture three acres of furze and heath and comon of pasture for all manner of cattle with the appurts in Syston als Sytheston Newton Harcourt and the Newarke neare the Burrough of Leicester aforesaid or by some other apt and convenient name or names discripcons or numbers of acres in the said fine comprized as by the record thereof remaining in the said Court reference thereunto being had may more at large appears How this Indenture wittnesseth And it is declared and fully agreed upon by and between the said parties hereunto for themselves and their heires that the said ffine as aforesaid or in any other manner acknowledged and levyed was before att and after the time of the levying thereof intended to be and enure And it is hereby declared and agreed that the said ffine levied and acknowledged as aforesaid and alsoe all and every other ffine and ffines already had and levied by or between the said parties to these presents or any of them either by themselves alone or together with any other person or persons whatsoever of the said cottage or tenement and premisses or any part thereof either by themselves alone or together with any other lands or hereditaments whatsoever shalbe and enure and shalbe adjudged deemed esteemed and taken to be and enure As to for and concerning the said cottage or tenement and all and singular other the premisses in Newton Harcourt aforesaid To the only use and behooffe of the said Richard Elkington his heires and Assignes for ever And to none other use intent or purpose whatsoever In Witness whereof the parties first above named to those present Indentures Interchangeably have sett their hands and seales the day and yeare first above written.
